WHERE IS THIS FRAUD HAPPENING?
The cover-up and corruption runs deep within the Birmingham Multiple Listing Service and the Birmingham Association of Realtors. The leadership and directors at both the Birmingham Multiple Listing Service and the Birmingham Association of Realtors, in Alabama, know there are agents using false advertising and misleading information to deceive consumers regarding square footage, acreage, and the age or year-built of a home. However, the leaders and directors, agents and brokers appear to be more concerned with making a sale and the almighty dollar than they are about adhering to the law and their "strict code of ethics" that they claim to maintain. This corruption and fraud continues to be brushed under the rug for the sake of making sales over the consumers' rights, health, and safety.
Thank you to the honest agents, inspectors and appraisers who are doing their job and trying to keep all consumers informed and protected against the cover-up and fraud that continues in the Birmingham market. And part of any agent's job is to protect their clients and all consumers from any known fraud or misrepresentation. We wish ALL agents would adhere to the code of ethics they are supposedly bound by, do their job honestly and help put a stop to the cover-up and corruption in their business--this is part of their job!
This Chinese drywall cover-up and robo-dating scam (changing the year-built dates of homes) in the real estate community has been uncovered in the Birmingham, Alabama, metro area for several years. And perhaps, it may be practiced nationwide. Several whistleblowers within the local real estate community -- including appraisers, inspectors, and honest real estate agents -- have contributed to the information on this website.
The leadership and directors at both the Birmingham Area Multiple Listing Service (MLS) and the Birmingham Board of Realtors have been made aware of this fraud, but both parties continue to ignore the problem in order for sales to continue. They claim that the description of "new" or "new construction" is justified because the home has never been lived in. But this is simply a cover-up strategy to avoid the real issue of the actual, quantitative DATE the home was actually built. Again, we are not talking about descriptive fields, but the actual, numerical field of a date that has to be entered into the MLS system for every home. They are allowing illegal and unfair competition among sellers and ignoring the fraud that is being committed against consumers, appraisers, insurance underwriters, and mortgage lenders and underwriters (see #4 under How This Robo-Dating Fraud Affects You).
The Birmingham Area MLS, the Birmngham Builders President, and the Birmingham Board of Realtors are more concerned with making a sale and the almighty dollar than they are about adhering to their "strict code of ethics" that they claim to maintain. This fraud continues to be brushed under the rug for the sake of the sale!
A full investigation needs to be conducted by the Alabama Attorney General and the Federal Trade Commission for disciplinary action to be taken against these banks, agents, builders, and local MLS companies who have committed this crime against consumers, home buyers, and the real estate community. These individuals are NOT above the law and should be held accountable for deceiving the public and all consumers.
