Consumer Fraud & Real Estate Cover-up Continue in Birmingham, AL
Consumer Fraud, False Advertising & Real Estate Cover-up continues to impact all consumers in Birmingham Real Estate from 2007-2025.
Just like other nationally reported fraudulent business scandals, the Birmingham Association of Realtors, the MLS leaders, and many real estate brokers and agents continue to be deceptive and alter and delete data to cover-up the corruption and fraud in the Birmingham real estate market, dating back to 2005. Agents and their brokers continue to lie and deceive consumers about square footage, acreage, and the age or year a home is built. The MLS leadership and many agents practice ongoing unfair, deceptive, abusive acts & practices (UDAAP), deceiving consumers with ethics violations, false advertising & misleading data.
This consumer blog is intended to alert the public and is not related to any specific broker or agent. We appreciate the honest agents, inspectors and appraisers who are doing their jobs and trying to keep all consumers informed and protected against the cover-up and fraud that continues in the Birmingham market! Part of any agent's job is to protect their clients and all consumers from any known fraud or misrepresentation. We wish ALL agents would adhere to the code of ethics they are supposedly bound by, do their job honestly, and help put a stop to the cover-up and corruption in their business--this is all part of their job!
Some brokers who have been made aware of this issue have continued to allow their agents to be dishonest and deceptive and to cover-up the issue as best they can. In some cases, they have fired honest agents who bring this matter to the attention of the public and their clients. It appears that the brokers involved are more concerned with selling homes and making money, instead of protecting consumers and their clients' best interests. They allow certain agents to continue to fudge the numbers with this deceptive practice in the real estate business to the disadvantage of honest agents and honest sellers.

For example: Within the first three weeks of 2024, hundreds of homes are stated as being built in 2024, yet the average Days on Market for these homes is 91 days on the market! Many of them show DOM as much as 300, 400, 500, 600, and over 700 days on the market - years! In addition, as of February 2024, there were already over a thousand homes that were listed as built in 2024 in the Birmingham MLS system.

These dishonest agents changed & altered the YEAR BUILT date on those homes sitting to claim they were NEW 2015 homes to mislead all buyers into thinking these existing homes have not been sitting empty on the market. Double check any of these homes, there is not one thing 2015 in them. They were built in 2013 or 2014. The MLS records, permits, city inspections, roof, systems, plumbing, electrical, HVAC, water heater are all 2014 or earlier! We know--we & many agents have been inside many of them back in 2013 & 2014.
Any agents calling a house "new" and changing the YEAR-BUILT DATE when it is 1-4 years old, is misleading and an exaggeration in order to deceive the consumer into believing the home has not been sitting empty for months or years, and that the consumer is buying a newer home than when it was roofed and built. This practice is illegal and gives an improper advantage over all the other honest agents and sellers.
A federal judge has ruled that nearly 4,000 homeowners in Alabama & the Southeast, who say Chinese drywall ruined their homes are eligible to share any further damages he may award in lawsuits against Taishan Gypsum Co. Ltd., a government-owned manufacturer that failed to show up in court.
All consumers, home buyers, and home sellers need to be aware that we are all victims of consumer fraud and real estate deception and misrepresentation. Some real estate agents have deceived the public with false advertising, and have misrepresented and concealed pertinent facts, such as square footage, acreage, possible toxic Chinese drywall, relating to homes sold in the last several years, dating back to 2005. They have committed this fraud by illegally changing the year-built date of homes for sale, also called "robo-dating," and deceiving the public into thinking there is no health risk with possible Chinese drywall. In addition. hundreds of agents deceive consumers by lying and advertising exaggerated square footage, false acreage and the incorrect age of hundreds of homes.
Similar to the robo-signing practice that banks used during the recent foreclosure scandal, robo-dating is when a new year-built date (more current than the original) is automatically "stamped" (or changed) on the home in order for it to sell more quickly because it appears to be a newer home than it actually is.
To clarify, this issue is not talking about "new construction" as some may say. The issue is changing the field "YEAR BUILT DATE." This is concerning the specific, quantitative year-built DATE that is entered in the Multiple Listing Service system, NOT a frivolous adjective like "new." Some agents & builders will try to deceive consumers and say a home can be "new" because it has never been lived in, but the actual year built DATE CANNOT be changed as to WHEN the house was actually built!
Any agents or builders calling a house "new" & changing the YEAR BUILT DATE when it is 1,2,3,4+ years old, is misleading and an exaggeration in order to deceive the consumer into believing the home has not been sitting empty for years, and that the consumer is buying a newer home than when it was roofed and built. This is Consumer Fraud 101.
This practice misleads consumers by falsely advertising a home to have been built a year (or more) later than it really was, in order to appear younger and newer than competing homes on the market. All consumers--including both home buyers and sellers--are victims of this fraudulent misrepresentation.
Robo-dating is also occurring in order to cover-up the age of a home that may contain Toxic Chinese drywall, which was used in many homes nationwide and has since been proven to be a health hazard.
Toxic Chinese drywall was manufactured in China and installed in countless homes throughout America that were built in 2002 through 2009. If a home's year-built date has been changed, then you could be the owner of a home that contains possible Toxic Chinese drywall, putting you and your family at a huge health and safety risk!
The unethical real estate agents, banks, or builders are trying to cover-up when the home was actually built to falsely advertise that the home was not built during a year when Chinese drywall was used, when in fact it was.
The year-built date of a home should NEVER change.
The accurate year-built date of a home has NOTHING to do with when the home is sold or becomes occupied, but is actually during the year when:
- The original roof is on, and
- the walls have been dry-walled, enclosing all electrical, wiring, plumbing, heating/cooling, duct work, and systems within the walls.
Once a home's major systems have been inspected by local municipal inspectors, the walls have been dry-walled, and the roof is on, then the "clock" begins, and the year-built date for that home is set permanently. The year built has nothing to do when the home actually sold or became occupied!
All of these systems (as well as the roof) begin to age, deteriorate, and show wear and tear from that point on. They are not considered "new" forever. Just like a car, the year-built date does not change just because it sits on the lot and doesn't sell.
In fact, some of these systems can even age more progressively if not used while the home is sitting empty, than if the home had been occupied. Similar to a car that sits in the driveway for months or years, a home and its systems can also age and deteriorate rapidly.
A home's year-built date NEVER changes, but unethical real estate agents, builders, and banks are doing it all the time just because:
- the home has not sold during the previous year(s);
- the home has never been occupied;
- the home has never received a Certificate of Occupancy; or
- the home has been renovated with new carpet, paint or new appliances.
Changing the year-built date of a home is the same fraud as rolling back the miles on a car's odometer to make it appear newer and younger than it actually is. The year-built date of a home should never "conveniently" roll over in January to the current year (after the house has not sold during the previous year), in order to make it more appealing to buyers.
Every January since 2005, agents, banks, and builders who have homes that have already been built and listed in the Birmingham (Alabama) Multiple Listing Service (MLS), robo-date or roll over their homes' year-built dates to the current year, which is illegal and deceptive to the public. We have hundreds of records, files, and advertisements showing this occurring since 2005.
Hundreds of homes built in previous years that are still sitting and have not sold, are being robo-dated and advertised as new homes today. Anyone can walk into these homes and verify there is not one thing dated with the current year. The walls, the roof, the HVAC, all electrical, plumbing, and all systems from previous years and cannot be sold to the public as brand new.
For example: On January 2, 2013, there were already five homes that were listed as built in 2013 in the Birmingham MLS system. Then, just two weeks later, there were 74 homes active in the Birmingham MLS as built in 2013. And by January 17, the number reached 91 (which, unless the homes are all brand new listings, would be impossible). By the end of the month, there were over 230 new 2013 homes listed. Some of those homes were already showing to have been built, sold, and closed the previous year! As of January 31 over 50 homes were built and sold to consumers claiming to be a new 2013. A home built, sold, and closed in less than 30 days? We have records and files showing this cover-up. This is clearly robo-dating--changing the year-built date of a home to make it look newer than it actually is. And this happens EVERY January!
The false advertising and misrepresentation of facts by these real estate agents and builders is evident. How long a house has been sitting on the market, when the house actually becomes occupied, or the date of the deed has absolutely no bearing as to the actual year-built date of the house.
The year-built date of a home should also never change when renovations have been made. When you sell a car, you may put on new tires, give it a new paint job, and change the fluids and filters. Those updates, however, do not change the actual date of the car and how old it is. In the same way, a homeowner or builder/contractor cannot make changes to a home with new paint, new flooring, finish a basement, or any other renovation, and then change the year-built date of the home just to make it seem newer than it actually is. This illegal practice has occurred countless times and continues to happen today. Once the home has been roofed and dry-walled from the beginning, then its year-built date is set permanently.
The cover-up and corruption runs deep within the Birmingham Multiple Listing Service and the Birmingham Association of Realtors. The leadership and directors at both the Birmingham Multiple Listing Service and the Birmingham Association of Realtors, in Alabama, know there are agents using false advertising and misleading information to deceive consumers. However the leaders and directors appear to be more concerned with making a sale and the almighty dollar than they are about adhering to the law and their "strict code of ethics" that they claim to maintain. This corruption and fraud continues to be brushed under the rug for the sake of making sales over the consumers' rights, health, and safety.
Thank you to the honest agents, inspectors and appraisers who are doing their job and trying to keep all consumers informed and protected against the cover-up and fraud that continues in the Birmingham market. Consumers can file complaints at a number of entities: the institution itself, the Better Business Bureau, State Attorneys General, the FTC’s Consumer Sentinel, the CFPB Consumer Response Center, other Federal and State agencies, or on-line consumer complaint boards such as www.ripoffreport.com or www.complaints.com.
The Alabama Deceptive Trade Practices Act-- "The following deceptive acts or practices in the conduct of any trade or commerce are hereby declared to be unlawful: ...Representing that goods are original or new if they are deteriorated, reconditioned or altered to the point of decreasing their value...Representing that goods or services are of a particular standard, quality, or grade if they are of another...Disparaging the goods, services, or business of another by false or misleading representation of fact..."
Federal Trade Commission law-- "Under the law, claims in advertisements must be truthful, cannot be deceptive or unfair, and must be evidence-based."
National Association of REALTORS - Code of Ethics-- "REALTORS® shall avoid exaggeration, misrepresentation, or concealment of pertinent facts relating to the property or the transaction."
The MLS leaders & some Realtors are dishonest. They are deceptive by false advertising, misleading and concealing facts to all buyers and consumers.
Hundreds of agents continuously deceive consumers by lying and advertising exaggerated square footage, false acreage and the incorrect age of hundreds of homes. Along with lying about a home's sqft size and acreage, agents continue to alter the year built to deceive the consumer. On January 1, 2025, there were zero homes recorded as built in 2025. On January 2, there were several homes that had their year-built dates changed from 2024 to 2025 by the agents. By January 7th, there were over 300 homes that had their year-built dates changed to 2025!
Every new year, hundreds of agents roll back the dates on homes that remain unsold on the market the previous year in order to claim they are new builds. This unethical practice misleads all buyers to believe these existing homes have not been sitting empty on the market. Double-check any of these homes -- nothing in them is dated 2025. The roof, systems, plumbing, electrical, HVAC, water heater are all older than what the agents are claiming, which is misrepresentation and false advertising!
FTC and CFPB say this is Consumer Fraud 101: The consumers, buyers, and the lenders are not getting what they were told and sold!
Changing the year-built date of a home is the same fraud as rolling back the miles on a car's odometer to make it appear newer and younger than it actually is.
Just like a car, one cannot change or alter the MPG and the year-built date does not change just because it sits on the lot and doesn't sell. How long a house has been sitting on the market, or when the house actually becomes occupied, has absolutely no bearing as to the actual year-built date of the house.
